Reports and Accountings of Fiduciaries

VA Code  § 64.2-1305 and  § 64.2-2020:

  • Accountings filed with the Commissioner of Accounts shall be signed under oath. 
  • Each now have a Penalty of Perjury*   
  • This effects the following forms:
    • CC-1680: Account for Decedent's Estate
    • CC-1682: Account for Incapacitated Adult
    • CC-1683: Account for Minor
    • CC-1684: Account for Trust

* VA Code  § 18.2-434: Violation of Perjury Laws is considered a Class 5 Felony. 

Fees Collected for Recording and Indexing

VA Code  § 17.1-275 and  § 64.2-409:

  • Increases by $2.00 the fee for the recording and indexing of certain documents, including plays or map sheets larger than 8.5x11 inches. This fee also applies to all Will and Fiduciary documents.
  • This increase to the recording and indexing fee collected by circuit court clerks is designated for use in preserving the permanent records of the circuit courts. 
  • The sum collected for this purpose shall be administered by the Library of Virginia in cooperation with the circuit court clerks. (Account code 145).

Clerk's Fee for Lodging Wills

VA Code  § 17.1-275:

  • Increases Clerk's fee for lodging of wills.
    • The current fee is $2.00 and this bill increases the fee to $5.00.
